By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Acceptance and Modification of Terms
By accessing our website, booking services, or participating in any FarmVentt activities, you accept these Terms in full. If you disagree with any part of these Terms, you must not use our services.
We may update these Terms periodically to reflect changes in our services, legal requirements, or industry standards. Updated Terms will be posted on our website with the effective date. Continued use of our services after updates constitutes acceptance of the revised Terms. We will provide at least 30 days' notice for significant changes.
2. Business Information and Legitimacy
FarmVentt operates as a legitimate agritourism business under proper licensing and regulatory compliance:
- California State Business License: Active and current
- Santa Clara County Operating Permit: Valid for agritourism activities
- USDA Organic Certification: Verified and maintained
- Liability Insurance: Comprehensive coverage for all activities
- Food Handler's Permits: Current for all food-related services
3. Services and Availability
FarmVentt offers authentic agritourism experiences including guided farm tours, seasonal fruit picking, cooking classes, animal interactions, overnight stays, and educational workshops. All services are subject to availability, seasonal conditions, weather, and operational capacity.
Service descriptions, pricing, and availability are accurate at the time of publication but may change due to circumstances beyond our control. We reserve the right to modify, suspend, or discontinue services with appropriate notice.
4. Booking Policy and Payment Terms
Reservations: All bookings require advance reservation and are confirmed upon receipt of payment and written confirmation from FarmVentt.
Payment: Full payment is required at the time of booking. We accept major credit cards through secure, PCI-compliant payment processors. All prices are in US dollars and include applicable taxes.
Pricing: Published prices are accurate at the time of booking. We do not engage in misleading pricing practices and comply with all truth-in-advertising regulations.
Group Discounts: Special rates may be available for groups of 10 or more with advance notice.
5. Cancellation and Refund Policy
Customer Cancellations:
- 48+ hours before experience: Full refund less 5% processing fee
- 24-48 hours before experience: 50% refund
- Less than 24 hours: No refund (exceptions for emergencies)
- No-shows: No refund
FarmVentt Cancellations: If we cancel due to weather, safety concerns, or operational issues, you will receive a full refund or the option to reschedule without penalty.
Refund Processing: Approved refunds are processed within 5-7 business days to the original payment method.
6. Safety Requirements and Conduct Standards
Safety Compliance: All participants must follow safety guidelines, wear appropriate clothing and footwear, and comply with staff instructions. Safety briefings are mandatory for all activities.
Age Requirements: Children under 16 must be accompanied by an adult. Some activities have specific age restrictions for safety reasons.
Health Considerations: Participants with health conditions, allergies, or physical limitations must inform us at booking. We accommodate reasonable requests but cannot guarantee suitability for all individuals.
Conduct Standards: We maintain a family-friendly environment. Disruptive, inappropriate, or unsafe behavior may result in immediate removal without refund. Prohibited items include weapons, illegal substances, and outside alcohol.
7. Liability, Insurance, and Risk Acknowledgment
Assumption of Risk: Participants acknowledge that farm activities involve inherent risks including uneven terrain, animal interactions, weather exposure, and agricultural equipment. Participation is voluntary and at your own risk.
Our Insurance: FarmVentt maintains comprehensive general liability insurance, professional liability coverage, and property insurance as required by law and industry standards.
Limitation of Liability: To the maximum extent permitted by law, FarmVentt's liability is limited to the amount paid for services. We are not liable for indirect, consequential, or punitive damages.
Participant Insurance: We recommend participants maintain personal health and travel insurance. Verify your insurance coverage includes agritourism activities.
8. Weather and Force Majeure Policy
Most outdoor activities continue in light rain with appropriate gear. Activities may be modified, postponed, or cancelled due to severe weather, natural disasters, government orders, or other circumstances beyond our control.
In such cases, we offer rescheduling at no additional cost or full refunds. We are not liable for travel expenses or other costs incurred due to force majeure events.
9. Photography, Media Rights, and Privacy
Consent: By participating in our activities, you consent to photography and videography for promotional, educational, and marketing purposes unless you explicitly opt out at check-in.
Usage Rights: Photos and videos may be used on our website, social media, marketing materials, and press releases. No compensation is provided for promotional use.
Opt-Out Process: Inform staff immediately if you prefer not to be photographed. We will make reasonable efforts to exclude you from group photos and marketing footage.
Personal Photography: Participants may take personal photos for non-commercial use. Commercial photography requires advance permission and may incur additional fees.
10. Intellectual Property Rights
All content on our website, educational materials, recipes, farming techniques, and proprietary methods are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from our content without written permission. Educational information shared during experiences is for personal use only.
11. Food Safety and Dietary Accommodations
Food Safety Standards: All food preparation follows California Department of Public Health guidelines and local health department regulations. Staff maintain current food handler certifications.
Allergen Information: We accommodate common dietary restrictions and allergies with advance notice. Cross-contamination may occur in shared kitchen facilities.
Organic Certification: Products labeled as organic meet USDA National Organic Program standards. Certification details available upon request.
12. Data Protection and Privacy Compliance

16. Dispute Resolution and Governing Law
These Terms are governed by California state law. Any disputes will be resolved through binding arbitration in Santa Clara County, California, under the American Arbitration Association Commercial Arbitration Rules.
Before initiating formal proceedings, parties must attempt good faith resolution through direct communication with our management team.
17. Severability and Entire Agreement
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, along with our Privacy Policy and Disclaimer, constitute the entire agreement between parties.
